Abstract

Islam is designated as the religion of the Federation of Malaysia based on Article 3(1) of the Malaysian Constitution. The aforementioned Article also designates the monarchy institution as a core matter in regards to the position of Islam in Malaysia. The Federal Constitution has established the Malay Rulers as the Custodians of Islam for the states with a monarchy, while His Majesty Yang Di Pertuan Agong acts as the representative of states without kings on matters pertaining to Islam. The power of the Malay Rulers as the custodian of Islam includes the responsibility to preserve the sanctity of Islam and the Malay traditional heritage at the state level. Three institutions have the role of assisting and advising the Sultan and act as the authority in Islamic affairs, the administration of justice and sharia rulings, which are the Islamic Religious Council, the Sharia Court and the Mufti. Lately, however, there have been various parties who raised issues related to Islam especially in masjid and zakat management. The issues include the need for credential certification for religious preachers in mosques, the prohibition of political talks in mosques, and on the distribution of zakat to non-Muslims. This article will highlight the role of the Malay Rulers as the Custodian of Islam in the context of legal in Malaysia and focus in solving issues pertaining to mosques and zakat in Selangor. The method of data collection is library research and document analysis. The data were analysed descriptively and based on content. The study shows that in the legislation in Malaysia, the Malay Rulers have a very important role as the Custodian of Islam. This role depicts the absolute power and responsibility of the Sultan on Islam at the state level. It shows the importance of the inherited role of the Sultan in preserving Islam in any condition.
